Professor Dr. Bernd Holznagel, LL.M. (McGill)
Professor Holznagel is a professor of constitutional law, administrative law, European law and administrative sciences at the University of Münster in Germany. He studied law and sociology in Berlin and passed his first state exam in law in 1984. After postgraduate LL.M. studies at McGill University Faculty of Law in Montreal, Canada, he received his Ph.D. at the University of Hamburg and passed the second state exam in law in 1991. He finished his habilitation at the University of Hamburg in 1995. Holznagel is chairman of the academic advisory council of the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railway. His research interests cover various areas of public law and regulatory law, including media, online communication and data protection law.

“The German Network Enforcement Act (NEA) – The Regulative Approach to Fight Digital Violence in Germany”
Professor Holznagel will talk about the compliance approach of the NEA. The NEA does not create any new deleting obligations but gives incentives for social networks to abide by the law. The NEA attracted a lot of attention and critique by the media in Germany as well as by foreign media. They say it poses a threat to freedom of speech. After explaining the provisions of the NEA, Professor Holznagel will assess its constitutionality and its effect on online communication.
